BY ENTERING THIS AREA, YOU ACCEPT THE FOLLOWING CONDITIONS OF ENTRY:

By completing your booking and proceeding with payment, you agree to these Terms and Conditions of Entry, including the following Risk Warning, Waiver, and Participant Warranties, as required by the event organiser’s insurer.

 

  1. Risk Warning and Assumption of Risk

You understand and acknowledge that participation in the “Snow4Kids” activities is for recreation, enjoyment, or leisure, and involves a

significant degree of risk of physical harm.

You are aware that by participating, certain risks or dangers may occur, including but not limited to:

  • Physical or Psychological Injury or death.
  • Physical exertion to which you may not be accustomed.
  • Failure of equipment or use of inadequate equipment.
  • The conditions in which the activities are conducted may vary without warning.
  • The actions or inaction of other participants, which the Provider is not liable for.
  • Injury or death resulting from the Provider’s negligence, breach of contract, or breach of statutory duty.
  • There may be no or inadequate facilities for treatment or transport if you are injured.

You acknowledge and accept that you undertake any such risk voluntarily and

at your own risk.

  1. Waiver and Exclusion of Liability

By agreeing to these terms, you agree to exclude, restrict, or modify your rights to sue the Provider in certain circumstances as permitted by law.

  • You agree to unconditionally

release, waive, discharge, and forever hold harmless the Provider or its employees, agents, directors, or officers, from any claims for personal injury sustained, including those caused by the Provider’s negligent act or omission, breach of contract, or breach of statutory duty arising out of or in connection with the activities.

  • You agree that the liability of the Provider for any

death or physical or mental injury suffered by you (or a person for whom you are acquiring the services) resulting from the supply of the recreational services isexcluded.

  • This exclusion of liability does not apply if your death or injury is due to

gross negligence on the Provider’s part (for services supplied in Victoria).

  1. Participant Warranties and Obligations

You confirm and agree to the following:

  • You are

medically and physically fit and able to participate in the activities.

  • You agree to abide by all of the Provider’s rules, directions, and instructions during the activities.
  • You will

disclose any pre-existing medical or other condition that may affect the risk of injury.

  • You will not engage in any reckless, negligent, or foolish behavior that is likely to cause injury to yourself or others.
  • If you suffer any injury or illness, the Provider may provide

evacuation, first aid, and/or medical treatment at your expense, and your agreement to these terms constitutes your consent to such treatment.

  1. Special Provisions for Group and Minors
  • Minors (Under 18): For any participant under 18 years of age, these terms must be completed and agreed to by a parent or legal guardian.
    • The Legal Guardian agrees to

indemnify and hold harmless the Provider from any liabilities arising from the minor child’s participation, even if arising from the negligence of the Provider.

  • Group Bookings: If you (the paying consumer) are not the sole user (i.e., a group or family booking), you must provide the names, ages, contact numbers, and email addresses for all users (or the parents/guardians of child users).
    • Separate waivers will be sent and must be agreed to and returned by each user or guardian before your payment is permitted and the activity commences.
  1. Snow4Kids play areas are made up of areas with man-made snow that can cause slips and falls that could result in injury or death. By entering, you agree that, to the full extent permitted by law, we will not be liable for any loss or damage, except to the extent the loss or damage was caused by our negligence.
  2. Snow, Ice and water are inherently cold, wet and slippery and you may suffer injury to yourself or your child if you fall or slip.
  3. Parents and carers must supervise their children at all times. Staff cannot supervise children. Carers must be over 18 years of age.
  4. Appropriate Clothing / Preperation

You understand and acknowledge that you are required to wear appropriate clothing and footwear that is suitable for participation in a snow event:

  • You and your child must wear appropriate footwear with non-slip soles for use on snow and wet surfaces.
  • Appropriate clothing such as gloves and warm non-slip footwear are essential for comfort and safety.
  • Babies and Toddlers are required to wear nappies and/or be toileted prior to entry.
  1. Visitors must follow directions given by staff, signs and audio announcements at all times.
  2. Please exit the event, areas or play zones promptly when directed to do so.
  3. No running. Use caution when moving about.
  4. No throwing of snow balls at other persons. if you do so and cause any damage or harm to other people you will be liable for any damages.
  5. Do not eat snow.
  6. Tobogganing Disclaimer

You understand and acknowledge that Tobogganing is a high-risk activity that can cause injury or death. You are required to follow the rules and staff directions at all times:

  • Please follow staff directions and signage at all times.
  • Only use toboggans/sleds and other equipment provided by the operator.
  • Only 1 rider per lane and toboggan/sled.
  • Do not walk/play on the toboggan hill.
  • Do not use the toboggan hill or participate in tobogganing if you are injured, unwell or have pre-existing injuries/conditions that can be worsened or triggered by participating.
  • Use the toboggan hill and equipment at your own risk.
  • No sliding or tobogganing on snow mounts. Only toboggan on the designated toboggan hill.
  1. Pregnant visitors and visitors holding children in their arms are not allowed on the snow and snow-covered areas at any time.
  2. Visitors that have had recent injuries, acute injuries, are feeling unwell or have undergone recent surgery should not enter Snow4Kids areas or Events.
  3. Prohibited Items

You understand and agree to not bring the following objects to Snow4Kids Events:

  • No sharp objects (jewellery, pins, pinned badges, needles)
  • No glass (bottles, containers etc.)
  • No skateboards, bikes, roller skates, ice skates, scooters
  • No personal sleds/toboggans
  • No food or drink
  • No pets (service animals are permitted)
  • No drugs or alcohol
  • No weapons, explosives or flammable substances
  1. 18. Snow4Kids is a family event. No alcohol or drugs are allowed at the venue. Snow4Kids reserves the right to remove guests that are under the influence from its venue. Furthermore, we reserve the right to remove guests displaying aggressive or irrational behaviour from our venue.
  2. 19. Snow4Kids reserves the right to refuse entry at its absolute discretion, to remove guests from the area/event and to inspect your bags at any time for security purposes.
  3. Play duration may be varied to minimize wait time. Areas may close temporarily for maintenance.
  4. Snow4Kids reserves the right to take photo images, video images and audio recordings for security, sales and marketing purposes.
  5. Any photographs, videos, or sound recordings taken by you must be for your personal use only. Any use, reuse or production for commercial purposes without our prior written consent is strictly prohibited.
  6. Entry is subject to our ticketing terms and conditions, which are published at snow4kids.com.au. By entering, you agree that you have read, understood and agreed to the conditions listed.
